Terms of Service

1. Acceptance of Terms
By accessing or using WindStorm Tracker, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.
2. Early Access Service
WindStorm Tracker is currently in Early Access. Customers who subscribe during Early Access lock in their rate forever — your subscription price will not increase as long as your account remains active. WindStorm Tracker reserves the right to add or modify features, but will not reduce core functionality without reasonable notice.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.
4. Acceptable Use
You agree to use WindStorm Tracker only for lawful purposes related to windstorm inspection job management. You may not use the service to store or transmit malicious code, or to interfere with the integrity or performance of the service.
5. Intellectual Property
You retain ownership of all data you enter into WindStorm Tracker. We retain ownership of the platform, its design, and underlying technology.
6. Limitation of Liability
WindStorm Tracker is a job management tool and does not replace professional engineering judgment. Users are responsible for the accuracy of all information entered into the platform and for compliance with TDI requirements.
7. Payment Terms
Subscriptions are billed monthly or annually in advance. Your subscription renews automatically unless cancelled. You may cancel at any time through your account settings — access continues until the end of your current billing period and you will not be charged again.
Refund Policy
We do not offer refunds for partial billing periods. If you cancel your subscription, you retain access through the end of your current billing period. Early Access subscribers who cancel and later resubscribe will be subject to pricing in effect at the time of resubscription.
8. AI-Powered Features
WindStorm Tracker includes Windy, an AI assistant powered by Anthropic's Claude. When you use Windy, your job details and questions are processed by Anthropic's API to generate responses. We do not use your data to train AI models. Windy's responses are informational only and do not constitute professional engineering advice.
9. Data Retention & Account Termination
When you cancel your subscription, your account and data remain accessible in read-only mode for 90 days. During this period, you may export your data or resubscribe to restore full access. After 90 days, your account and all associated data — including jobs, photos, and uploaded documents — are permanently deleted and cannot be recovered.
Accounts that remain inactive (no login) for 12 consecutive months may be flagged for deletion. We will send a reminder to your registered email address at least 30 days before any deletion occurs.
10. Data Security
All data transmitted between your device and WindStorm Tracker is encrypted in transit using TLS. Data stored on our servers is encrypted at rest. Each organization's data is logically isolated — users in one organization cannot access another organization's jobs, photos, or documents.
Access within your organization is controlled through role-based permissions. Account administrators control which users can view, edit, or manage jobs.
We do not sell your data or share it with third parties for marketing purposes. Job data may be processed by third-party services that are essential to product functionality (see Section 8 regarding AI-powered features). These services are contractually bound to handle your data securely and are prohibited from using it for their own purposes.
11. Free Trial
New accounts begin with a 14-day free trial with full access to all features of the selected plan. No credit card is required to start a trial.
At the end of the 14-day trial, if no payment method has been added, your account will be placed in read-only mode. Your data is preserved — you can view existing jobs but cannot create new ones or upload photos. To restore full access, add a payment method and subscribe at any time.
Trial accounts that remain in read-only mode for 90 days without subscribing may be flagged for deletion, with at least 30 days' email notice before any data is removed.
